Conveyancing that is fast and accurate
Stefan called our office for the first time and asked how quickly we could prepare a Contract of Sale for Conveyancing work on his house in Ascot Vale, Melbourne Victoria.
We said, "Straight away. On the spot if you have all the information"
He said, "I do, but we have to settle this afternoon!"
We said, "Sure."
The Contract of Sale was finalised and signed by all parties that morning. The paperwork was completed and we received a phone call from the purchasers' solicitor stating that he was coming in at 2pm with the cheque.
We nearly fell over. That afternoon the solicitor arrived at our Conveyancing office with a cheque for over 1million dollars.
The deal was signed sealed and delivered, same day! The purchaser was a very well known horse race owner who didn't gamble with amateurs.
Needless to say ‘Stefan' is still a valued client whom we have represented in many other property transactions.
Knowledge, backup and the right advice
Conveyancing work involves many various acts of parliament. It is important not only to know what you are doing when someone purchases a house, land or other type of Real Estate, but know how handle difficult and stressful situations. One such occasion was when ‘Bianca and Serge' were selling their home.
‘Serge' had ‘owner built' an extension on his house without a permit about 10 years prior to selling their house.
The purchasers' solicitor made enquiries with the local council about the extension and found out no permit had been obtained by ‘Serge' when he built it. Contracts had previously been arranged by our office and in conjunction with our retained solicitor we included many specialised ‘Special Conditions' to enhance the protection of our clients and the Contracts of Sale, were signed by all parties. The purchasers' solicitor ‘Fabio', instructed the council to do an inspection on the property. The council subsequently did an inspection and later made an order for the demolition of the illegal structure.
‘Serge' forgot to inform us about the illegal structure when instructions were taken from them to prepare the Section 32 Statements. However, through due diligence and experience, the Contract of Sale included some carefully worked special conditions to protect ‘Serge and Bianca.'
Because the Council issued the notice to demolish after the contracts were signed, that notice, became the purchasers notice. Therefore ‘Fabio' condemned his client to problem with the local council.
After much argument and conjecture, the purchasers' solicitor finally realised that we held the ‘better hand' and was powerless to turn the problem back onto our clients. The end result......it end up costing the other party in excess of $40,000 to rectify the problem and our client nothing at all.
The moral of this story was that experience counts and when Low Cost Conveyancing takes the time and effort to do the job right, it stands up.
